Landowners adjacent to state-owned land bordering the Missouri River may conduct prescribed burns on that state land in conjunction with burning their own property, after obtaining written consent from the department secretary or commissioner

Written requests must specify the purpose (controlling woody species and grassland management), describe both parcels of land, and provide the burn timeframe

Landowners conducting approved burns must provide reasonable fire suppression forces and equipment and comply with existing prescribed burning laws (§§ 34-35-9 and 34-35-10)

Landowners assume all liability for the prescribed burn; the state is granted complete immunity from any damages or causes of action arising from these burns

Declared an emergency measure, taking effect immediately upon passage and approval rather than the standard delayed effective date
