School boards may assign students to alternative instruction settings for aggressive or violent behaviors that disrupt school operations or affect health and safety

Alternative placement authority does not limit existing enrollment options under § 13-28-40 or override protections under the Individuals with Disabilities Education Act (IDEA) or Section 504 of the Rehabilitation Act of 1973

School districts must report all alternative setting assignments to the Department of Education by the second Friday of June each year using a department-prescribed form

Department of Education may only disclose reported data after it has been anonymized and aggregated with data from all other school districts
