Amends § 44-9-13 to clarify that contractors, subcontractors, or suppliers who receive property for real estate improvement and fraudulently use it for purposes other than paying for labor, skill, or materials are guilty of theft

Requires intent to defraud as an element of the offense

Subjects violators to penalties under § 22-30A-17 (South Dakota's general theft penalty statute, which bases punishment on the value of property stolen)

Applies to any improvement of real estate covered under the mechanics' lien chapter
