Division of Criminal Investigation may obtain national criminal history records for Indian tribes upon request for individuals in 10 categories of tribal positions

Covered positions include tribal council members, tribal court judges, conservation officers, gaming licensees, foster/adoptive parents, and those working with children or juvenile offenders

Indian tribes must submit completed fingerprint cards to the Division of Criminal Investigation for national criminal history record checks

Processing fees from either the Division of Criminal Investigation or FBI must be paid by the tribe or, if the tribe requires, by the applicant or position holder

Amends existing sections 23-3-15.1 and 23-3-15.2 of South Dakota law governing state-tribal cooperation on background checks
