Legislature appoints five delegates to represent South Dakota at an Article V constitutional convention, with delegates receiving the same salary and expense allowances as state legislators

Delegates must be at least 25 years old, registered voters, and state residents for at least five years; individuals disqualified if they were federal lobbyists (within 5 years), federal employees/contractors/officeholders (within 10 years), convicted of moral turpitude crimes, or hold statewide office

Delegates prohibited from voting on unauthorized amendments outside the convention's scope, amendments altering individual liberty guarantees in the Constitution and Bill of Rights, or changes to the one-state-one-vote convention rule

Delegates must take an oath acknowledging these restrictions and accepting potential recall; the Executive Board of the Legislative Research Council can recall delegates who exceed their authority and must respond to delegate inquiries within 24 hours

Bribing, threatening, intimidating, or obstructing a delegate constitutes a Class 6 felony; delegates may not accept gifts or benefits exceeding $200 combined value while serving
