Cast vote records and ballot images from automatic tabulating equipment are classified as public records under South Dakota's public records law (chapter 1-27)

County auditors are exempt from producing cast vote records or ballot images if their tabulating equipment software does not generate these records

Release of cast vote records or ballot images is prohibited if they reveal date/time/order of voting, contain unredacted personal voter information, show data in the order it was generated, or exclude any ballots cast at a location

Records from precincts or ballot styles with fewer than 100 ballots cast may only be released after redacting identifying information and combining with other precincts to exceed 100 ballots total

The jurisdiction conducting the election bears all costs for producing, storing, archiving, and releasing cast vote records and ballot images
