Individuals aggrieved by an order of the South Dakota Retirement System executive director may request a contested case hearing in writing if they believe the order contains a mistake of fact or error of law

Written hearing requests must be received within 60 days from the date the order was mailed by certified mail and must specify the portion being contested and the alleged error

Failure to submit a written hearing request within the 60-day deadline strips all courts of jurisdiction to hear any suit contesting the order

For requests sent by U.S. mail, the postmark date counts as the date received by the executive director

All hearings and subsequent appeals must follow procedures established in chapters 1-26 and 1-26D (administrative procedures and appeals)
