Prohibits intentionally misrepresenting an animal as a service animal in places of public accommodation to obtain rights or privileges reserved for individuals with legitimate service animals

Violations constitute a Class 2 misdemeanor

Defines "service animal" as a dog trained to perform specific tasks directly related to an individual's disability, consistent with federal regulations (28 C.F.R. § 36.104)

Explicitly excludes emotional support animals, comfort animals, and dogs whose only function is crime deterrence or companionship from the service animal definition

Adds a new section to South Dakota criminal code chapter 22-35
