State officers or employees who approve, award, or administer contracts are prohibited from being employed by organizations that received those contracts for 1 year (contracts up to $5 million) or 2 years (contracts over $5 million) after leaving state employment

The prohibition applies to those who directly handle contracts, supervise contract administrators, or recommend contract approvals on behalf of state agencies

Governing bodies may grant written exemptions allowing early employment if they review the contract terms, the employee's role, and determine the arrangement is fair, reasonable, and in the public interest

All exemption authorizations are public records and must be filed with the Commissioner of Human Resources and Administration for annual review by the Government Operations and Audit Committee

Officers serving without compensation or receiving only per diem payments are exempt from these restrictions
