South Dakota applies to Congress under Article V of the U.S. Constitution for a convention of states to propose amendments on three topics: fiscal restraints on the federal government, limiting federal power and jurisdiction, and term limits for Congress and federal officials

The application remains in effect until two-thirds of state legislatures (34 states) submit applications for a convention on the same subjects

Congress's role is limited to ministerial duties only—setting the time and place for the convention—with no authority to determine convention rules or select delegates

The convention must operate on a one-state, one-vote basis and is strictly limited to the three specified topics, with any amendments to the Bill of Rights expressly prohibited

The Legislature retains authority to instruct South Dakota's delegates and may recall them at any time for violating instructions or breaching their duties
