Legislative Description

As introduced, enacts the "Fish Before Coal Act," which prohibits the issuing of a surface coal mining permit that would impact a stream that has fishing as a designated use, unless the commissioner of environment and conservation makes a finding that the mining activity would not cause a diminution of the stream as a fishing resource. - Amends TCA Title 59, Chapter 8, Part 4 and Title 69, Chapter 3, Part 1.
