LEAs may enroll non-at-risk children in voluntary pre-kindergarten programs when at-risk enrollment does not fill available classroom space by the initial deadline

Eligible non-at-risk children include 4-year-olds residing in the LEA's area, 3-year-olds who were in the Tennessee Early Intervention System or identified as educationally at-risk under IDEA, and 3-year-olds from families qualifying for free or reduced-price lunch

Children of LEA employees who are 4 years old by August 15 may enroll even if they reside outside the LEA's geographic area

LEAs may charge tuition and fees to children of LEA employees enrolled under this provision, capped at the LEA's actual costs for enrollment and attendance
