Law enforcement agencies must request an immigration detainer from ICE as soon as practicable after taking custody of an individual known to be unlawfully present in the United States

Agencies must hold individuals for the maximum time specified in the detainer or until ICE takes custody, whichever comes first

If no detainer is received or ICE does not take custody in time, agencies must transport the individual to an out-of-state sanctuary city of the individual's choice within 700 miles

Law enforcement agencies must report monthly detention and transportation costs to the Department of Revenue, which will request federal reimbursement from the U.S. Treasury

If federal reimbursement is not received within 30 days, Tennessee will withhold an equivalent amount from federal motor fuel taxes collected by the state that would otherwise be remitted to the Federal Highway Administration
