Property qualified as agricultural land, forest land, or open space land under the Agricultural, Forest and Open Space Land Act of 1976 is deemed to have unchanged ownership when one co-owner dies and the surviving owner retains the property through right of survivorship

Applies to property owned by two individuals and held as tenancy by the entireties or joint tenancy with right of survivorship

Ownership is also deemed unchanged when divorced co-owners divide the property and one owner retains it through the divorce proceeding

Amendments affect Tennessee Code Annotated Sections 67-5-1005 (agricultural land), 67-5-1006 (forest land), and 67-5-1007 (open space land)

Passed March 20, 2025 and signed by Governor Bill Lee on April 3, 2025, taking effect immediately upon becoming law
