First-time violation of driving without a license (TCA § 55-50-301(a)(1)) classified as a Class B misdemeanor

Second or subsequent violations elevated to a Class A misdemeanor

Prior convictions older than 10 years cannot be used to enhance charges to the higher misdemeanor level

Penalty enhancements do not apply to violations of § 55-50-351 (driving while license canceled, suspended, or revoked)

Effective July 1, 2025, applying only to offenses committed on or after that date
