Requires all LEAs (local education agencies) to submit comprehensive listings of underutilized and vacant property to the Department of Human Services and comptroller of the treasury, making these lists available to child care facilities operating in the LEA

Grants independently-owned child care facilities the right of first refusal to purchase vacant LEA property or lease underutilized/vacant property at or below fair market value for child care services; in LEAs with charter schools, child care facilities receive second right of refusal after charter schools

Fair market value must be determined by averaging two independent appraisals, one selected by the LEA and one by the child care facility operator

Child care facility lessees are responsible for routine maintenance and utilities, while LEAs remain responsible for capital expenses; any capital improvements made by the facility must be credited against lease costs
