Employers must pay wages owed to a deceased employee directly to the surviving spouse (or a trust for their benefit), or if no spouse exists, to surviving children as tenants in common

After 6 months without a personal representative being appointed, non-employer parties holding funds for a decedent may pay up to $10,000 directly to the surviving spouse or children

Funds exceeding $10,000 must be paid to a personal representative or as ordered by the court

All payments under these provisions are charged against the elective share, homestead allowance, and year's support allowance; payments to minors must go to their guardian or custodian

Takes effect immediately upon becoming law (passed March 27, 2025; approved April 11, 2025)
