Magistrates may consider hearsay evidence when deciding whether to release a defendant, provided the evidence is deemed reliable and the defendant has a fair opportunity to rebut it

Magistrates may also consider reliable hearsay evidence when setting bail amounts to ensure defendant appearance and public safety

Defendants must be given fair opportunity to challenge any hearsay evidence used against them in release or bail determinations

Amends Tennessee Code Annotated Sections 40-11-115 and 40-11-118

Passed April 14, 2025 and approved by Governor Bill Lee on April 24, 2025, taking effect immediately
