Selling or distributing vapor products to individuals under 21 years of age becomes a Class A misdemeanor, upgrading the existing penalty

Beginning December 1, 2025, all vapor product retailers must obtain a license from the Department of Commerce and Insurance at $250 per year per location, with sales restricted to face-to-face transactions at licensed, age-restricted businesses

Age-restricted vapor product businesses must require customers to be 21 or older to enter, verify age through photo ID, and derive at least 75% of gross sales from vapor products and accessories

Civil penalties for violations escalate from $5,000 for a first offense to $25,000 plus a 15-day license suspension for a third violation, with license revocation on the fourth violation within three years

The Department must conduct compliance inspections at least annually and investigate all license applications within 60 days
