Law enforcement officers are granted immunity from civil liability for property damage or personal injury caused during official duties if the injured person is subsequently convicted of an offense under § 39-16-602 (evading arrest/resisting stop)

Immunity does not apply if the officer's actions constituted gross negligence or willful misconduct

Bystanders or other persons not engaged in conduct resulting in a § 39-16-602 conviction remain able to pursue civil claims for damages

Passed March 28, 2025 and approved by Governor Bill Lee on April 11, 2025

Takes effect immediately upon becoming law under public welfare provision
