Requires prior written and oral informed consent before performing drug or alcohol tests on pregnant patients, patients less than one year postpartum, or newborns in licensed healthcare facilities

Consent forms must warn patients that positive test results could have legal consequences, including potential reporting to the Department of Children's Services, and that they may want to consult legal counsel

Allows testing without consent only in medical emergencies where delay could increase risk to the patient's or newborn's life or health, with required post-test notification of results and rights

Prohibits healthcare facilities from refusing treatment to pregnant patients, postpartum patients, or newborns solely because of refusal to consent to drug or alcohol testing
