Private prison facilities with inmate death rates twice that of equivalent state-operated facilities must reduce their population by 10% within 90 days of the department's annual statistical abstract report

Applies to facilities operating under correctional services contracts and county facilities holding state inmates through contracted correctional services

Population reduction must continue until the department determines the conditions causing the elevated death rate have been corrected

Death rate comparisons are based on data reported in the Tennessee Department of Correction's annual statistical abstract

Took effect immediately upon becoming law (approved May 9, 2025) due to public welfare necessity
