Public charter schools authorized in a county LEA may use available buildings or facilities located within a city school system's boundaries in the same county, provided the county has only one city school system and the charter school needs additional space

Charter schools must enter into a written lease agreement for such facilities, and the buildings cannot be in an LEA established on or after January 1, 2014, or one with certain written agreements under § 49-2-140

Students enrolled in charter schools using city school system facilities remain students of the charter school's authorizer and cannot be classified as out-of-district students for funding or enrollment purposes

LEAs without authorized charter schools but hosting charter schools using facilities under this provision are exempt from certain compliance requirements under Section 49-13-136(c)

Effective upon becoming law and applies to the 2025-2026 school year and thereafter; passed April 21, 2025 and approved May 21, 2025
