Misdemeanor charges against defendants found incompetent to stand trial must be retired no later than 2 years after the date of arrest, unless the defendant is restored to competency before that deadline

When a defendant with retired charges is released into the community, the chief officer must notify the court of the discharge and provide an outpatient treatment plan addressing community safety to both the court and sheriff

For defendants charged with misdemeanors who remain hospitalized 2 years after arrest, court reporting obligations continue until the defendant is discharged

Amends Tennessee Code Annotated Sections 33-7-301 and 52-6-102 with parallel provisions for incompetency determinations

Takes effect July 1, 2025
