Individuals whose name or address was included on a business filing with the Tennessee Secretary of State without their consent may file a formal complaint to challenge the document

The Secretary of State must notify the business entity within 10 business days of receiving a valid complaint, and the entity has 21 business days to respond; failure to respond results in the allegations being deemed admitted

If clear and convincing evidence shows a person's information was used without consent, the Secretary of State must void the challenged business record

Both the complainant and respondent may seek judicial review of the Secretary of State's decision, and all complaints and responses are public records

Effective July 1, 2025; no refunds are issued for filing fees on voided filings
