Racing facilities and racetracks receive immunity from nuisance, taking, or other legal claims brought by surrounding property owners who purchased or built their property after the racetrack was established

Immunity applies to properties within a 5-mile radius of the racing facility's perimeter and remains in effect regardless of changes to the facility's size, scope, configuration, technology, or type of racing

Local governments are prohibited from adopting ordinances, resolutions, or regulations that would restrict, limit, or prohibit racetrack operations in a manner inconsistent with this immunity

Racing facilities must still comply with state and federal environmental laws and health and safety regulations

Takes effect immediately upon becoming law and applies to claims filed after the effective date, regardless of when the alleged cause of action arose
