Jailers may refuse to accept arrestees who require medical attention and have been arrested for a misdemeanor that is not a crime against a person under Title 39, Chapter 13.

When a jailer refuses an arrestee under this provision, the arresting agency must have the arrestee evaluated by a healthcare provider.

Jailers must accept the arrestee once a healthcare provider furnishes a release form stating the person no longer requires medical attention or is medically fit for jail confinement.

Jailers who refuse arrestees under this new section are exempt from contempt of court provisions in TCA § 29-9-102.
