Property owners entitled to just compensation from public entities when land use regulations enacted after property acquisition reduce the fair market value of their property

Compensation equals the reduction in fair market value as of the date the owner makes a written demand; owners must file claims within 3 years of regulation enactment or land use application submission

Exemptions include regulations addressing public nuisances, public health and safety (fire codes, pollution control), federal law compliance, and restrictions on pornography/nude dancing establishments

Public entities may alternatively modify, remove, or waive the regulation to restore previously permitted uses; such waivers run with the land

Property owners may sue in circuit court and recover attorney fees if compensation is not paid within 90 days of written demand
