Allows healthcare providers to voluntarily communicate with patients or families after adverse incidents without those communications constituting an admission of liability or waiving Quality Improvement Committee (QIC) confidentiality protections

Protects open discussion communications from discovery, subpoena, or use as evidence in judicial, administrative, or arbitration proceedings

Requires healthcare providers to notify patients in writing of their right to legal counsel before participating in open discussions and that participation does not extend statutes of limitation unless agreed in writing

Establishes formal requirements for waiving confidentiality of open discussion materials, including written consent specifying covered materials, purpose, and duration, with the ability to revoke at any time through written notice
