LEAs and public charter schools must allow privately-paid licensed behavior analysts access to students with autism spectrum disorder or developmental delays during the school day to provide applied behavior analysis services in classroom and other educational settings

Schools must provide necessary accommodations including classroom access and appropriate space, and cannot charge fees or impose barriers that hinder private pay providers from accessing students

Private pay providers must coordinate with IEP teams, obtain written parental consent, complete background checks, and provide proof of licensure before delivering services on school premises

Schools are prohibited from discriminating against students receiving private pay services or retaliating against students, parents, or providers, and are not responsible for costs unless specified in an IEP or legal agreement

Disputes between schools and providers or parents regarding access will be resolved by a Department of Education-appointed hearing officer, with the law applying beginning the 2026-2027 school year
