Political subdivisions (counties, municipalities, metropolitan governments) may require developers to construct or fund offsite public infrastructure improvements through cost-sharing arrangements based on proportionate utilization or impact of the development

Public infrastructure covered includes roads, streets, traffic signals, turn lanes, sidewalks, lighting, stormwater improvements, and utilities (water, wastewater, electric, gas, broadband) that will be dedicated to public entities

Political subdivisions must make cost-sharing determinations within 60 days of receiving a developer's approval request

Developers who cannot reach agreement with political subdivisions may request the Tennessee Board of Utility Regulation to determine the cost-sharing amount

Political subdivisions may fund their share through impact fees from other developments, bond proceeds, or unencumbered tax revenues
