Local boards of education may contract with nonprofit or for-profit entities to operate and manage adult high schools, with contracts required to specify maximum enrollment caps.

Contracted operators must report enrollment to the local board at least 3 times per year (August, December, and April), with anticipated enrollment due 4 months before opening for new schools.

Local boards must adjust payments to contracted adult high schools at least 3 times per year (October, February, and June) based on changes in revenue, student membership, or student services.

First-year funding is based on anticipated enrollment; subsequent years' funding is based on the prior year's enrollment, with adjustments made according to the contract schedule.

Effective July 1, 2026, applying to contracts entered into, renewed, or amended on or after that date.
