Tennessee Department of Education must elect to participate in the federal scholarship tax credit program established under Section 70411 of Pub. L. No. 119-21 for contributions to scholarship granting organizations.

Department must annually submit by January 1 to the U.S. Secretary of the Treasury and publish on its website a list of all qualifying scholarship granting organizations located in Tennessee.

Department must accept submissions from scholarship granting organizations throughout the year and certify its authority to submit the state list to federal officials.

State agencies are prohibited from promulgating rules to implement this section, and compliance requirements apply for taxable years beginning after December 31, 2026.

Act takes effect immediately upon becoming law.
