Eligible state employees who have worked full-time for at least 12 consecutive months must be granted 12 weeks of absence for recovery from living organ donation surgery, with the time counted as full-time employment for service anniversary calculations.

Private employers with one or more employees must grant eligible employees (as defined by FMLA) 12 weeks of absence for living organ donation surgery recovery.

Insurers are prohibited from denying, canceling, or varying terms of life, disability, or long-term care insurance policies based solely on a person's status as a living organ donor, unless there are actual, unique, and material actuarial risks.

The Department of Health, in consultation with the Department of Commerce and Insurance, must produce and publish educational materials on living organ donation by July 1, 2025, covering benefits, risks, and insurance access implications.

Employees must provide 30 days advance notice of surgery when possible, or notice as soon as reasonably possible if learning of the surgery date with less notice.
