State and local law enforcement agencies are prohibited from assisting federal immigration enforcement actions unless federal authorities certify in writing that the individual is not a veteran or that veteran status has been confirmed by the VA.

Law enforcement must screen individuals for veteran status before honoring any immigration detainer or transfer request, and cannot transfer anyone with indicated veteran status until verification is complete.

Detention or transfer of veterans for immigration purposes requires both a valid judicial warrant and written certification that veteran-specific immigration relief has been considered.

Veterans in state custody facing immigration proceedings must be informed of their right to consult an attorney specializing in military-related immigration relief and given access to records proving their military service.

Evidence obtained in violation of these requirements is inadmissible in state proceedings, and affected individuals may sue for injunctive or declaratory relief.
