LEAs and public charter schools must allow privately-paid licensed behavior analysts access to students with autism spectrum disorder or developmental delays during the school day to provide applied behavior analysis services in classroom and other educational settings.

Schools must provide necessary accommodations including classroom access and appropriate space, and cannot charge fees, impose barriers, discriminate against students receiving services, or retaliate against families or providers.

Private pay providers must coordinate with IEP teams, obtain written parental consent, pass background checks, and provide proof of licensure before delivering services on school premises.

Disputes between schools and providers or parents regarding access will be resolved by an impartial hearing officer appointed by the department, with primary consideration given to the student's best interests.

Applies to the 2026-2027 school year and thereafter; the department must develop implementation guidelines and model agreements for distribution to schools.
