Data center owners/operators must pay the full cost of infrastructure needed to support their facilities, including roads, water, wastewater, electric transmission lines, substations, and utility upgrades

Electric utilities are prohibited from raising rates for residential or other commercial/industrial customers due to increased electric demand caused by data centers

Electric utilities must create ratemaking structures ensuring all data center infrastructure and electric service costs are paid solely by the data center owner/operator

Before imposing any rate increase, electric utilities must make a written finding that the increase is not attributable to data centers and make that finding publicly available

Customers who believe a utility has violated these provisions may file complaints with the Tennessee Public Utility Commission or the utility's governing board; effective January 1, 2027
