HOA and unit owners' association restrictions on licensed family child care homes and group child care homes are void and unenforceable if the provider has obtained proper state and local licenses and permits

Landlords are prohibited from refusing to rent single-family or multifamily dwellings to tenants who operate or plan to operate licensed child care homes

Landlords may require tenant-operators to provide notice of license applications, maintain liability insurance, add the landlord as additional insured, obtain permission for structural changes, and follow reasonable rules for shared spaces

Willful violations by HOAs or landlords result in liability for actual damages plus punitive damages up to $1,000

Applies to HOA declarations created or amended and rental agreements entered into or amended after the act's effective date
