Municipalities must submit a financial impact study and statement of financial viability to the county legislative body before adopting any annexation ordinance, demonstrating capacity to provide water, sewer, roads, police, fire, and other services.

County legislative bodies must approve annexations by majority vote; they have 60 days to review and vote, and failure to approve within 90 days results in automatic denial.

Annexations of single, contiguous lots of 5 acres or less are exempt from these requirements.

The Comptroller of the Treasury will prescribe the required form and content for financial impact studies and viability statements.

Existing interlocal agreements and growth plans under Chapter 58 are not preempted by these new requirements.
