TN SB2346

Prohibits public and private schools, charter schools, and the State Board of Education from hiring, retaining, or licensing individuals found by the Department of Children's Services to have committed child abuse, severe child abuse, child sexual abuse, or child neglect, but only after due process rights have been offered and either declined or fully exhausted.

Requires the Department of Children's Services to conduct emergency file reviews for current or prospective school employees with pending abuse/neglect investigations or findings to determine if they pose an immediate threat to children's safety.

Establishes a procedure for schools to submit employee names to the Department of Children's Services to check for child abuse findings, and bars employment of individuals on the state's vulnerable persons registry, sex offender registry, or equivalent out-of-state registries.

Allows license-exempt child care agencies to request Department of Human Services reviews of employees or potential employees for records of child or adult abuse/neglect.

Takes effect upon becoming law for rulemaking purposes, with all other provisions effective July 1, 2026.
