Local boards of education may contract with nonprofit or for-profit entities to operate and manage adult high schools, with contracts required to specify maximum enrollment caps.

Contracted operators must report enrollment numbers at least 3 times per year (August, December, and April), with anticipated enrollment due 4 months before opening for first-year schools.

Local boards must adjust payments to contracted adult high schools at least 3 times per year (October, February, and June) based on changes in revenue, student membership, or services.

First-year adult high schools receive state and local funding based on anticipated enrollment; subsequent years receive funding based on prior year enrollment, with adjustments per the contract schedule.

Effective July 1, 2026, applying to contracts entered into, renewed, or amended on or after that date.
