TX HB1271

Removes the "opposite sex" requirement from the affirmative defense to prosecution for indecency with a child, allowing the defense to apply regardless of the sex of the actor and victim

Maintains existing affirmative defense requirements: actor must be no more than three years older than the victim and must not have used duress, force, or threats

Preserves restrictions preventing the affirmative defense for individuals required to register as lifetime sex offenders or those with prior reportable convictions for indecency with a child

Applies to offenses committed on or after September 1, 2025, and to pending criminal actions for offenses committed before that date

Does not affect final convictions for indecency with a child that exist before the effective date
