Winery permit holders may purchase malt beverages from distributors and sell both wine and malt beverages to consumers for on-premises consumption at restaurants they operate on winery premises

Brewer's license holders authorized for on-premises sales may purchase wine from wholesalers and malt beverages from distributors, and sell both at restaurants they operate on brewery premises

Food must be available at these manufacturer-operated restaurants at all times alcoholic beverages are sold

Manufacturers operating restaurants must maintain detailed records for Texas Alcoholic Beverage Commission inspection, including menus with prices, food preparation equipment lists, hours of operation, floor plans, daily sales summaries separating alcohol/food/other sales, and purchase invoices for 4 years

Failure to maintain or provide required documentation constitutes prima facie evidence of noncompliance and grounds for disciplinary action against the permit or license holder
