Amends Section 22.011(b) of the Texas Penal Code to expand the definition of when a sexual assault is considered "without consent"

Adds that sexual assault occurs without consent if "consent, as defined by Section 1.07(a), is not present" in addition to the existing enumerated circumstances (such as force, threats, unconsciousness, mental incapacity, etc.)

Retains all existing circumstances that constitute lack of consent, including coercion by public servants, exploitation by healthcare providers, clergy, coaches/tutors, and caregivers

Applies only to offenses committed on or after the effective date; prior offenses remain governed by former law

Takes effect September 1, 2025
