Health and Human Services Commission must establish a prescription drug purchasing pool allowing participants to buy prescription drugs at discounted rates negotiated by the commission

Eligible participants include health benefit plan issuers (insurers, HMOs), qualified public employers (counties, municipalities, school districts, universities, quasi-public agencies), and self-insured private employers operating in Texas

The pool is not a risk pool; each participant remains responsible for paying their own claims and prescription drug costs according to their coverage agreements with employees, dependents, and retirees

Participants may purchase optional stop loss coverage from an insurer at commission-negotiated rates, and two or more participants may jointly purchase prescription drugs without being classified as a multiple employer welfare arrangement

The executive commissioner must adopt rules establishing eligibility criteria, enrollment procedures, duration of participation, contribution methods, and disenrollment processes, with the act taking effect September 1, 2025
