Prohibits public institutions of higher education from taking action against student organizations based on requirements that leaders or members affirm the organization's sincerely held beliefs, comply with standards of conduct, or further the organization's mission or purpose

Allows persons or student organizations to sue institutions within one year of alleged expressive rights violations, seeking declaratory judgment or injunctive relief

Treats each day a violating rule or policy remains in effect as a separate violation for purposes of the one-year limitation period

Permits individuals or organizations to raise violations of their expressive rights as a defense or counterclaim in disciplinary, civil, or administrative proceedings brought against them by the institution

Waives sovereign immunity for public institutions of higher education for liability created under this section, with an effective date of September 1, 2025
