Electric utilities must maintain a list of priority facilities in their retail service area, including each facility's name, type, and address

Priority facilities include hospitals, police stations, fire stations, critical water or wastewater facilities, and confinement facilities operated by or under contract with the Texas Department of Criminal Justice

Electric utilities must provide an online mechanism for facilities to request addition to the priority facility list, and must respond within 14 days to inquiries about whether a facility is on the list

When the governor declares a natural disaster or emergency affecting a utility's service area, the utility must provide the priority facility list to the Texas Division of Emergency Management

Priority facility lists submitted to the Texas Division of Emergency Management are confidential and exempt from public disclosure requirements under the Texas Public Information Act; effective September 1, 2025
