Adds a new offense for knowingly selling, renting, leasing, loaning, or giving a firearm to a person receiving court-ordered inpatient mental health services, acquitted by reason of insanity, committed to residential care for intellectual disability, under guardianship for mental incapacity, or determined incompetent to stand trial

Creates a defense to prosecution if the firearm recipient has obtained a judicial order or finding that they are no longer incapacitated or has received federal relief from disabilities under 18 U.S.C. Section 925

Expands the unlawful transfer of firearm statute under Section 46.06, Penal Code, to include transfers to individuals with specified mental health adjudications or determinations

Applies only to offenses committed on or after September 1, 2025; prior offenses remain governed by existing law
