Adds a new provision to Texas Penal Code Section 22.011(b) establishing that sexual assault occurs without consent when the actor knows the other person is intoxicated by any substance to the degree they cannot appraise the nature of the act

Creates an additional provision defining sexual assault without consent when the actor knows the other person has withdrawn consent and persists in the act after consent is withdrawn

Applies only to offenses committed on or after the effective date; offenses before that date remain governed by prior law

Takes effect September 1, 2025
