Prohibits parents, conservators, or individuals with custody of a child from transferring custody to another person with intent to abandon parental rights and responsibilities, except through legal channels such as adoption, judicial custody awards, child-placing agencies, or voluntary delivery to emergency infant care providers

Creates criminal penalties for illegal custody transfers: Class B misdemeanor for violations, upgraded to third-degree felony if the child has been previously adopted

Prohibits soliciting or advertising to facilitate illegal custody transfers or to act as an intermediary; violations are Class A misdemeanors, upgraded to third-degree felony for repeat offenders

Exempts transfers to parents, stepparents, relatives by blood or marriage, close family friends, Indian custodians, or members of a child's customary family unit recognized by their indigenous group

Authorizes the Department of Family and Protective Services to investigate suspected violations, conduct home visits, and for intercountry adoptions, report to the U.S. Department of State on the child's welfare and permanent placement plan
